The article doesn't give specifics of the crime but there must be something that leads to cops to believe he wasn't trying to kill her. Maybe they charge him with it after the DA reviews the evidence

Probably the right legal decision but the Times really showed their colors with that one.  To say it was just an accident assumes all people are stupid.
