Whatever risk you think there is to one or more of the parties involved, I am merely saying it is almost completely unbelievable that there is no language in the existing deal that addressed it.

It is very much not believable that all parties missed this detail

There is no risk to ESPN.  They have an agreement for the playoffs no matter what.

What's at stake is the 100 million extra that MLB bargained for on an expanded playoffs format.  Extra games MLB didnt really have any right to negotiate with.  That extra 100 mil is what the fight is going to be over, and why I pointed out it is going to be an issue in response to EG.

As it stands now, that all goes to the owners.

I better understand your point now.

The Giants would not have picked anybody. They would've had a bye.

In the current scenario... they wouldn't have had a bye. if they picked, it would've been after the WC series.

In the new proposal from MLB, they'd have had a bye, correct, but then presumably would've been able to pick the winner of one of the three series.

I don't understand why they can't sit down like adults and negotiate.

Owners: We want additional playoffs. More games and More teams.

Players: OK, have you considered adding two teams so there are more jobs for us? Plus expansion fees it would help with revenue "losses" from 2021.

Owners: Ok good point. If we add two teams will you agree to a salary cap?

Players: No, but we would consider a modified luxury tax if it came with a floor threshold. Two tiers each.

Owners: Ok, how about a $200 Million dollar luxury tax and a $75M floor.

Players: How about $250 and $125.

Owners: Let's meet in the middle at $225 and $100 but a soft cap, with penalties on both sides.

Players: Ok, well, if you factor in adjustments based on media contracts, average ticket price, and attendance numbers, unless you want to open your books further? And will the penalties be distributed to the players?

Owners: Hell no we're not opening our books, ok we agree on adjustments on those three factors.

Players: Only increases though, no reduction, but we'll give you a pandemic clause. And the Penalty Money?

Owners: Ok, that works for us. Penalty money distributed equally across all non-tax paying teams.

Players: And it's spent on the following years players salaries?

Owners: Uh, no, how about 1/2.

Players: 2/3.

Owners: Ok. Can we get 4 extra playoff teams then?

Players: Sure, if you lower arbitration to second year. And free agency to year 5.

Owners: How about in the third year, regardless of service time, and in the sixth season, regardless of service time. September callups excluded.

Players: Or at age 28. Whichever is sooner.

Owners: At 30.

Players: We can agree on 29. But we want free agency after 5 full years, or sixth year of service.

Owners: If you'll limit contracts to 6 free agent years. And agree to arbitration based on WAR.

Players: 7 free agent years, and we get universal DH.

Owners: Done. But we need an updated cheating policy and updated domestic violence policy.

Players: Only if more additional playoff revenue comes to players. And a cut of merchandising revenue.

Owners: We'll give you 1/3 of the extra money for Playoffs, if you agree to the arbitration changes.

Players: Well, 1/2 only if the WAR number for arbitration is calculated based on average player salary plus 25%. And players get a bigger cut of their jersey and memorabilia sales.

Owners: We can live with that. If you let us sell advertising on uniforms and broadcast more games on MLB and streaming platforms. And gambling revenue.

Players: We can do that too. Assuming we get a cut of new streaming revenue, and uniform advertising revenue.

Owners: Ok, great. We'll draw up the new CBA and get it to you for review next week.

Players: Great.
