Should the Boston bomber be treated as an enemy combatant?

Shouldn't the owner of the fertilizer retailer be an enemy combatant? Is he not a terrorist?  He defied the DHS and created a bomb much more powerful than those in Boston.

Anyone that murders waged a war against humanity. I feel our domestic legal system is more the acceptable to deal with terrorists. We have anti-terrorism laws on the books with penalties for breaking them. We should be using that system to prosecute, not one that ignores basic rights.

It was good enough for McVeigh and it worked.  I didn't hear any complaining then.

McViegh acted alone on his own agenda, he was not working in concert or on behalf of a terrorist organization.

As far as what pieces, so far I've seen the fourth through the ninth mentioned as ones that should not apply to this kid.

No MT, McVeigh did was terrorism, domestic terrorism. It was not however a terrorist act in cahoots with an enemy of the state terrorist organization. 

 

What part of the 4th and 9th Amendmemts has been suggested should not apply to this terrorist?

If there is no info linking him to an organization or foreign country then he needs to be subject to the US Legal system that everyone else is. Charge him for the federal crimes and execute him once found guilty. Id say the only way you could charge him as a combatant is if he legally denounced his citizenship and this was an act against the US Government.

I don't really disagree with most of that. Why would he have to denounce his citizenship?
