Glen, you seem to think that justices make their decision on something besides the law. They follow the Constitution.

They interpret the Constitution along with law to establish new parameters of how each are used to rule on law, which in turn can result in new law. There is no mathematical formula of constitution + precedence = judgement.

Practically speaking, judges vote on ideology. All sides know that. When one side wins, they say it's plainly in the constitution. When the other wins, it's bias. 

 

Objectively speaking, one side, however, acknowledges that they just make things up according to ideology.

Glen wants a SC that won't uphold Obamacare, rule gay marriage to be legal or rule that someone suing under fair housing law doesn't need to prove that a developer or the government knowingly discriminated.
