The problem here is he has proof of her saying "hit me". He may have gone too far. And that will be for the DA and court to decide. But hes got a very good defense.

This isnt a question of bauer being right. Or being white. Or rich. Or being a baseball player. This is exactly how it would play out regardless of who he is. I could be wrong here, but just going based off experience. She didnt report it. SDPD responded because the hospital notified them (mandated reporters). (I might be screwing that up though, ill have to go back and re-read it.

And ill cut slack on that. She very well could have still been in shock. And that isnt uncommon. 

But the problem a prosecutor is going to have is the fact she went back a second time, after the first one he supposedly sodomized her when she was passed out. 

From the text exchanges, it sounds like she was fine with whatever happened the first time (unless im reading the texts and timelines wrong), but is adding it to the second incident as if to show a pattern. Sure, it could be. But its almost creating his defense for him.

To me, it sounds like he went way too far the second time. But I think a DV case is going to be filed over a sexual assault case. And even that will be tough to convict on, but Id submit it for filing.

No, not at all. The problem is she gave him consent and asked him to strike her. Said she was good with being choked. 

He could have gone too far. I wouldnt have a problem with the DA saying so. But he has a credible defense (laid out in text messages, and the fact she went back twice).

And just to clarify here, Im not defending bauer. And im gonna be all over my dodger fan buddies for this. Nor am I trying to ignore the female, and have no problem if this goes forward.

Just saying its going to be a tough sale for the DA to press forward with this one.

Like @UndertheHalo is saying, the injuries are the only thing to go on here. No go on sex assault. 

Had she reported this after the first time, the sodomy charge could fly. But she kind of loses that by returning a second time.

Ill also add that as of now, we only have her statement. And its he said she said.

I have no idea when she sent them (before first time or after). And youd need more context (what was being talked about leading up to that).

But if that was sent after the first time, where shes not complaining, saying she liked it (when later saying she didnt, was sodomized, etc) its going to he hard to believe her.

Ill say this. Porn has made everyone goofy. Porn has increasingly gotten more and more hardcore, and made things that used to be "holy shit!" normal.

The butterfly effect of that is that people in real life, who watch too much of it, are bringing it into real life.
