Local governments, and then people can sue and appeal to higher courts if they don't like a decision. The Supreme Court has created several important precedents surrounding free speech.

It's not perfect, but how else should it be done? If you go down the rabbit hole of, "Who has the authority to determine ____________," then you might as well have anarchy.
