It was up to the states, some did, some didn't.  Some states had school only a couple months a year, most didn't require attendance.

Yep, and there would be other states that would go that same route.  Creationism is the oldest fake news and has no place in the science classroom.

the DoE exists only because Mondale made a campaign  promise to the NEA (ie teachers union). In turn, the NEA endorsed Carter - the first candidate they had ever endorsed. Prior to that it was handled under Dept of HEW.  Carter called out the federal government for "bureaucratic buck passing" in regards to education.

His solution? He did what libs love to do. He created another bureaucracy.
