Doesn't matter, cops have authority and will just write the ticket for talking or texting (even if the person wasn't), and there will be no way for people to defend it in court.

 

Same way the cop can write you a ticket for not stopping at a stop sign even if you did.

There are already laws on the books for distracted driving.  Should we have one also for each kind of distracted driving?

It baffles me how badly people drive because of the phone distractions.

I almost hate cellphone drivers as much as I hate drivers in a Prius.

I don't see the difference between using gps on a phone or using gps installed in a car.

If I was the one making the laws then if you caused an accident while staring at your phone you would be required to chop the phone into pieces, batter it, fry it, and eat it. Only a first offender would be allowed any dipping sauce.

Nevada passed a similar law not too long ago. I have been tempted to hold my wallet up to my ear and then see the look on the cop's face as he tries to write me a ticket for talking to it.

 

Of course, being Las Vegas, he would call for backup and eight officers would shoot me as I sat in my car on the side of the highway.
